Joaquin “El Chapo” Guzmán presented a new judicial appeal in the United States requesting a new procedure to be judged, according to file 09-CR-466. The capo is serving a sentence life imprisonment in one of the most secure prisons in the world, the United States Penitentiary, Administrative Maximum Facility or ADX Florence.
The co-founder of Sinaloa Cartelimplausible as it may seem, asked to be release him immediately arguing alleged irregularities in the procedures that completed his transfer from Mexico and his media trial in the United States.
Among the irregularities cited by the capo is the refusal to assert his right to the effective assistance of a lawyer. Curiously, the document is only signed by the chapo and his lawyer, Mariel Colón Miró.
“Presumably he has some behind-the-scenes advice. But yes, on the face of it, he’s asking for it himself,” said former federal prosecutor and ABC7 legal analyst Gil Soffer.
“Regarding the first failure of counsel, Petitioner previously challenged the district court’s determination that he lacked standing to challenge, tainted by fraud on the part of U.S. authorities, a post-extradition specialty exemption rule obtained from Mexico that allowed the prosecution in Brooklyn instead of Texas or California, as stipulated in the extradition request and decree, ”said the request consulted by Infobae México.
Despite the “unlikely possibility”
In another part of the document it is detailed that “despite the decision of the district court that prohibited the defense from inspecting the documents presented to Mexico in support of the request for resignation, the lawyer did not demand a closed-door inspection of those documents. This omission prejudiced the petitioner’s appeal rights.
At the end of the application filed by “El Chapo”, it was indicated that despite the “unlikely possibility that the petitioner would be acquitted”, the prosecution did not make any effort to agree to a favorable negotiation through a guilty plea, so the cumulative effect of these errors deprived the “Chapo” Guzmán of a fair trial.
Be a new legal resource of the compadre of the May Zambada seeks to take “another bite out of the apple,” said Gil Soffer. “He lost his trial, he lost on appeal, but this is a mechanism for him to say, despite all of that, I still have a right to a reversal of my conviction and a new trial, because my constitutional rights were violated.”
